Terms and Conditions

The owner of this website is imagineear Ltd, 2nd Floor, Cardiff House, Tilling Road, London NW2 1LJ.  Registered VAT number 971 9709 73.  The following terms and conditions will apply between you and imagineear Ltd, when you buy an item from imagineear.com.  The terms do not affect your statutory rights.

General
  • Your contract for purchases made through the site is with imagineear.com and you undertake that any and all goods ordered by you are for your own private and domestic use only.
  • You warrant that all details you provide to imagineear.com are for the purpose of ordering or purchasing goods are true, accurate, current and complete in all respects; and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.
  • You must be eighteen years old or older to use this site.  If you are under eighteen, you may only use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use this site.
  • You agree that e-mail can be used as a long-distance means of communication.
  • If there are any changes to the details supplied by you it is your responsibility to inform imagineear.com as soon as possible.
  • You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we dispatch the good (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).
  • Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law.  Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
  • We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.

Liability
  • We do not accept liability (except as set out below) for any errors and/or omissions contained in our website and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.
  • The products sold on the Site are provided for private domestic and consumer use only.  Accordingly, imagineear.com does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of imagineear.com or for any products or services purchased from imagineear.com.
  • Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
  • Please note that in some cases, we accept orders as agents on behalf of third party sellers.  The resulting legal contract is between you and that third party seller, and is subject to the terms and conditions of that third party seller, which they will advise you of directly.  You should carefully review their terms and conditions applying to the transaction.
  • We may also provide links on our site to the websites of other companies, whether affiliated with us or not.  We cannot give any undertaking that products you purchase from third party sellers through our site, or from companies to whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are DISCLAIMED by us absolutely.  This DISCLAIMER does not affect your statutory rights against the third party seller.

Orders
  • A contract for the sale of any product will exist between you and imagineear.com once we accept your order by dispatching the product to you.  When this happens we will confirm the acceptance by sending you an e-mail (whether or not you receive that e-mail).
  • You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.
  • If your delivery address is outside of the UK, you may have to pay import duties and taxes, which are levied once a shipment reaches your country.  You must meet any additional charges for customs clearance.  Please note, customs policies vary widely from country to country.  We recommend you contact your local customs office for further information.
  • Please note international shipments may be subject to cross-border inspections by customs authorities.
  • The Products will be at your risk from the time of delivery.
  • Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.
  • We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
  • Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period.  We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

Payment
  • For online and telephone orders we accept MasterCard, VISA and American Express cards, as well as UK debit cards.
  • All credit and debit cardholders are subject to validation checks and authorisation by the card issuer.  If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Errors and returns
  • If an error is discovered in the price of the goods that you have ordered, we will try to inform you as soon as possible.  We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price.  If the item(s) has been charged and not dispatched we will cancel and refund your order.
  • imagineear.com will do its best to correct errors and omissions as quickly as practicable after being notified of them.
  • In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify us of the problem in writing to customersupport@imagineear.com within 10 working days of delivery of the goods and return the goods to us, unless we inform you that return is not necessary.  This provision does not affect your statutory rights.

Privacy policy

imagineear Ltd, is committed to ensuring that your privacy is protected.  This policy explains how we use the information we collect about you and the procedures that we have in place to safeguard your privacy whilst you use the website.  We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998, or the “Act”). 
  • For the purpose of the Act, the data controller is imagineear Ltd 2nd Floor, Cardiff House, Tilling Road, London NW2 1LJ.
  • When you register with imagineear and/or place an order, we need to know your name, delivery address, e-mail address and telephone number.  This information allows us to fulfil your order and notify you of the status of your order.
  • By submitting your information and using our website, you consent to the transfer, storing or processing of your personal information by us in the manner set out in this Policy.  If we change our Privacy Policy we will post the changes on this website so that you are always aware of what information we collect, how we use it and under what circumstances we disclose it.
  • We follow strict security procedures in the storage and disclosure of the information which you have given us.  This is to prevent unauthorised access or unlawful processing of your personal information.  We keep your information confidential and store it on a secure server which is password protected and hidden behind a firewall from the outside world.
  • The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services.
  • We may also use your information for the purpose of providing you with information about any special offers and any features of our website which we think may be of interest to you and for related marketing purposes.
  • We may use your IP address to help diagnose problems with our server and to administer our website.  Your IP address is also used to help identify you and your details on our database.
  • You agree that we may, from time to time, send inserts advertising the goods or services of unrelated third party companies.
  • We do not pass on your personal data to these third party companies.
